No-fault divorces for couples with children require that couples live separately and apart continuously for at least one year. However, couples without children may obtain a no-fault divorce if they live separately and apart continuously for six months. You and your spouse settle on property division and have a written agreement.
In contrast, fault grounds for divorce include adultery, felony conviction, desertion, or cruelty. To file on these grounds also requires separation for at least a year or more.
