How to File for a Virginia Beach Uncontested Divorce

To file for divorce in Virginia, you or your spouse must be a Virginia resident for a minimum of six months prior to filing, must be separated for at least six months, and must have a written property settlement agreement. Also, you need to obtain the following documents:

  • Addendum
  • Final order
  • Request for Ore Tenus
  • VS-4 (Report of Divorce or Annulment)
  • Waiver of service
  • Acceptance of service
  • A self-addressed stamped envelope
  • Complaint for divorce
  • Cover sheet

Once you obtain these documents, the following steps are required:

  • Fill out and make two copies of the complaint for divorce form. Sign and make one copy of the cover sheet and the acceptance and waiver forms.
  • File all relevant forms and pay the filing fee to the Office of the County Clerk of the Family Court. When you file the complaint and cover sheet, the clerk will give you a VS-4 form to complete and sign, and a case number to write on all of your paperwork.
  • Notify your spouse. Send your spouse a copy of the complaint, the original waiver, and the acceptance forms via certified mail. Have your spouse sign the waiver and the acceptance forms before a notary public, and return them to you so that you can file them with the court.
  • Copy the executed waiver and acceptance forms, and complete the addendum form by filling in the social security numbers of you and your spouse, along with your dates of birth. Sign the addendum and request for Ore Tenus hearing. Make one copy of the following documents for your record and mail the originals to the court:
  • Addendum
  • Final order
  • Request for Ore Tenus
  • VS-4
  • Waiver of service
  • Acceptance of service
  • Self-addressed stamped envelope
  • Attend the Ore Tenus hearing. The court will notify you of the date and time of the Ore Tenus hearing. Bring one witness who can testify about how long you and your spouse have been separated. The judge enters the decree for divorce at this time.
